ClientEarth is working with lawmakers to remove remaining barriers to the development and deployment of carbon capture and storage technology in power generation.  This legal policy report aims to influence European Commission Guidance documents regarding the obligations on CCS operators under the CCS Directive to have in place necessary financial security arrangements.

The risk has been identified that some of these requirements may be prohibitive to the CCS industry given theoretically unlimited liabilities, particularly associated with leakage.

At the same time, adequate financial security is essential from an environmental and public health perspective. This detailed report contains in-depth legal analysis and creative design work to present a range of solutions to address this important problem. The report is directed to the European Commission and Member State governments planning their transposition and implementation of the Directive, and to NGOs wishing to influence these processes.
