Article 5 of the proposal for Energy Efficiency Directive addresses an issue of energy efficiency in public procurement. Some voices were raised arguing that this provision is not compliant with EU public procurement legislation. The memorandum demonstrates that these arguments are not correct and that Article 5 of the proposal for an Energy Efficiency Directive and EU Public Procurement legislation (existing legislation and proposals for the future) are complementary.
