This briefing explains how the principles of non-discrimination, equal treatment, and transparency have been analyzed and applied within the context of European Union law governing public procurement. In addition, we analyze the reasoning of the European Court of Justice to draw further lessons for how these principles should apply to
procurement criteria aimed to fulfil horizontal objectives such as promoting sustainable development.
