Legal considerations surrounding the introduction of an Emissions Performance Standard at EU Level

The EU has the power to put in place an emissions performance standard (EPS) like that introduced by the US yesterday. Such a law would set a maximum level of CO² emissions that European power plants could emit, helping to fight climate change. This is the conclusion of this report by ClientEarth and WWF, which showed that an EPS law could be introduced as a new legal instrument, or could sit within existing climate and energy policy.
