This memo explores the new Comitology rules developed after the changes introduced by the Lisbon Treaty. The briefing presents the new rules and procedures applied for the adoption of non-legislative acts under EU law. The procedures for both implementing acts and delegated acts are different and require the involvement of different bodies and EU Institutions in their adoption. These differences might be the potential for institutional disagreement over the classification of acts, as delegated or implementing and over the choice to use one or another category to be determined by the legislator in a legislative act.
